Controlled Medication Prescribing

In May 2023, the Drug Enforcement Agency (DEA) issued an announcement on the status of tele-health prescribing of controlled medications. The announcement states that a temporary rule will take effect allowing online psychiatry offices, such as Lavender, to continue prescribing controlled medications to new and existing clients on an ongoing basis without an in-person exam requirement. A secondary rule is now in place, extending telemedicine flexibility for prescription of controlled medications through to December 31, 2024. Lavender will continue to follow updates and remain in compliance with rules and regulations set forth by the DEA. 

Lavender clients will not have to attend an in-person visit to receive a controlled medication prescription in 2024. If in the future, the DEA requires in-person exams for controlled medication treatment, Lavender is prepared and able to see clients for in-person visits when needed. 

All prescribing decisions are always made with careful consideration based on the NPs clinical judgment, and not specific client requests. Lavender’s approach to high quality mental health care and responsible prescribing includes:

  • Longer appointments that combine therapy with medication management to strengthen the therapeutic relationship and allow NPs to make the most informed prescribing decisions. 

  • Consistent Board Certified Nurse Practitioner providing care throughout the client’s treatment journey 

  • All visits occur via HIPAA compliant and live face-to-face video– no asynchronous care

  • Robust clinical policies to ensure NPs adhere to best practice standards

  • At the present time you do not require an in-person evaluation to be prescribed controlled medications.

  • If you’re being prescribed any medications, we require you to have a monthly virtual visit with your Nurse Practitioner to receive a refill. We typically only provide a 30 days supply of medication at a time.
